Will a Medical Marijuana Card Show Up on a Background Check?

DocTommy.com“The simple answer to this question is no. Because you only have a medical marijuana card on the recommendation of your doctor, it is therefore considered to be part of your private medical history. All data relating to a US citizen’s health records are protected under the federal Health Insurance Portability and Accountability Act (HIPPA), which means the data is not in the public domain and so should not be picked up by a background check…. It should be noted that the card itself is issued by the state and is not formally protected under HIPPA. However, it is given special protections because of the implied knowledge of your health records that it could give. As a result, state officials are not permitted to access information about it or to pass any details about it on to third parties. No personal data (such as your social security number) is attached to your card either. Even the marijuana dispensary you use can only check whether your card is valid or not. It is therefore pretty much impossible for your card to show up on any background check.”  (Source: Addictive Tips) Read How to Be Sure Your Medical Marijuana Card Doesn’t Show up on a Background Check and Best Background Checking Sites to See if Your Medical Marijuana Card Shows up and more…

“Feel Good” News!

Have you heard about Enedina Stanger?  She is an amazing, living-proof-advocate of the benefits of Medical Marijuana! She was diagnosed with Ehlers-Danlos Syndrome (EDS) (a group of disorders that affect connective tissues supporting the skin, bones, blood vessels, and many other organs and tissues), a painful disorder that cause Enedina’s bones to slip out of place. The world was first introduced to Mrs. Stanger and her condition when her husband competed on American Ninja Warrior in 2015 while she sat on the sidelines in a wheelchair, unable to walk and with a limited, life expectancy.  Over the last 3 years, we have seen Enedina become a MMJ advocate and actually walk and stand on the sidelines during her husband’s ANW course run!  In an ANW episode that aired July 9, 2018, Enedina Stanger made her first run on the course!!!

“Enedina is not afraid to talk about her use of medical cannabis. ‘The United States is still in the ‘cannabis closet’ she explains. ‘We need to talk more about why it works.’ Initially starting the conversation with family and friends, she is now a local cannabis educator as well as a national advocate. ‘We shouldn’t be afraid of speaking to our doctors about treatment we need. If something will help, don’t take no for an answer.'” (source: The Invisible Project)

Read more of Enedina Stanger’s incredible and inspirational story (check out the links at the bottom of the article) and celebrate her healing as you watch the video of her ANW run below!

EMERGENCY REGULATIONS EFFECTIVE IMMEDIATELY: New York State Department of Health Announces Opioid Replacement Now a Qualifying Condition for Medical Marijuana.

“Effective immediately, registered practitioners may certify patients to use medical marijuana as a replacement for opioids, provided that the precise underlying condition for which an opioid would otherwise be prescribed is stated on the patient’s certification. This allows patients with severe pain that doesn’t meet the definition of chronic pain to use medical marijuana as a replacement for opioids. In addition, the regulation adds opioid use disorder as an associated condition. This allows patients with opioid use disorder who are enrolled in a certified treatment program to use medical marijuana as an opioid replacement.” Source: NYS Department of Health Press Release

U.S. Senate Votes To Legalize Hemp After Decades-Long Ban Under Marijuana Prohibition.  The U.S. Senate passed the 2018 Farm Bill, which includes provisions to legalize hemp (cannabis’ non-psychoactive cousin) for the first time since the 1930s.  Senate Majority Leader Mitch McConnell (R-KY) initially sponsored a standalone, legislation to legalize hemp , provisions for which are included in the larger Farm Bill and also makes hemp plants eligible for crop insurance.    Read more…

POLICING: Colorado Schools Are Using THC Test Strips to Find Out What Students Are Vaping. “Particularly in states with legal cannabis, schools have tried a variety of methods to prevent student vaping. Vape pens intended for nicotine are nearly indistinguishable from vapes designed for marijuana, meaning law enforcers often can’t tell what someone is vaping.  Administrators at Yampah Mountain High School in Colorado are employing a newly-developed cannabis detection S2 test strip, allowing educators to find out what students are vaping without police intervention.  Prior to using the S2 test strips, the school administrator would call police to have potential pot products tested.  FYI, police departments have also begun to use these strips to test for cannabis and may use them to crack down on people having a puff on the street.  Read more…

Lagunitas Debuts Hops Cannabis-Infused Sparkling Water.  Lagunitas, a Califonia craft brewery, debuts the first product released by a major brewery in a state-legal cannabis market.  The THC-infused beverage, an IPA-flavored seltzer water called Hi-Fi Hops comes in two varieties: a 5mg of THC and 5mg of CBD infusion and another with 10mg of THC and no CBD, for a stronger buzz. “We’ve often dreamed of hops and their cannabis cousin partying together at the family reunion. We wanted to bring this party to life in a beverage. It’s high-time that good beer inspired a provocative, yet refreshing non-alcoholic alternative. With a smidge of California sun-grown cannabis in every sip.” — Jeremy Marshall, Brewmonster, The Lagunitas Brewing Company  Read more…

Safe Memorial Day Fun

Hurray!  We’re about to launch the Summer Season!  Here are some tips to safely enjoy your Memorial Day Weekend adventures.

Prepare to spend more time outdoors.

  • Protect yourself in the sun with sunscreen.  First, to avoid sunburn and skin damage, picnic under a tree, take a canopy to the beach and chill beneath an umbrella.  SPF-rated moisturizers, sunscreens, and lip balms are not created equal, so peruse The Environmental Working Group’s Guide to Sunscreens.

Hydrate.  It’s important to stay hydrated throughout the day with water-rich fruits and vegetables like watermelon, cucumbers and bell peppers as well as ice pops — here’s Martha Stewart’s easy, any juice ice pop recipeNote: One of our patients makes this recipe with NO sugar or substitutes the sugar with honey water.

Make Healthy Food Choices.  To make it easier, The Environmental Working Group has many wonderful resources for you to seek and find information concerning food safety and more!

  • The EWG’s Food Score Guides help consumers make healthier, greener food choices.  More than 80,000 products are rated on a scale of 1 (best) to 10 (worst) and scored on three criteria: nutrition; ingredient concerns (including factors such as the likely presence of key contaminants, pesticides, hormones and antibiotics, and the health implications of certain food additives); and processing (the extent to which a particular food has been processed).  You can look up a product; search by company; search by category; and find better alternatives.  Take advantage of this amazing, free resource!
  • Grill Veggies!  As we mentioned, it is important to hydrate and eating cruciferous (high, water content) foods makes a great contribution to your water intake.  And vegetables are good for you! So, cook a veggie kabob as part of the meal and check out some delicious, vegetable grill recipes from Food and Wine.

Get Moving.  Just because you may be enjoying a cookout doesn’t mean you have to spend the day eating! Be sure to get a little fun exercise in – throw the ball, play badminton, dance, etc.!

Be Safe. Be Prepared.  Here are excerpts from The American College of Emergency Physicians Top Tips to a Safe Memorial Day Weekend.  Read the full tips and article here.

  • #1: Food Safety — Refrigerate all perishable food within 2 hours, 1 hour if the temperature outside is above 90 degrees; guard against cross-contamination of bacteria, keep uncooked meats away from other foods; avoid food poisoning by cooking fresh poultry to 165 degrees, hamburgers to 160 degrees and beef to at least 145 degrees.
  • #2: Grill Safety — Thoroughly clean a grill of any grease or dust; prevent an uncontrolled fire by checking the tubes leading into the burner for any blockages from insects or food grease;  prevent gas leaks by replacing any connectors; and keep lighted cigarettes, matches or open flames away from a any grill.
  • #3: Water Safety — To prevent drowning, avoid alcohol when swimming or boating; wear a life-jacket whenever you are on a boat;  make sure  are supervise young children at all times; don’t swim alone or in bad weather; learn and teach your children to swim; learn CPR in case of an emergency.
  • #4: Sun Safety — Wear sunscreen with at least an SPF of 15 or higher and apply it generously throughout the day; wear a hat outdoors and a good pair of sunglasses to protect your eyes; drink plenty of water, especially when in the sun or if you are sweating heavily; if you feel faint or nauseous, get into a cool place immediately. (See sun safety tip above.)
  • #5: Travel Safety – Take along a traveler’s first aid kit to help you be prepared for common emergencies. Avoid talking or texting on a cell phone while driving.

We encourage you to stay up-to-date with the rapidly changing policies concerning Medical Marijuana (from farming to distribution), especially with the new administration and its choices for its officers.

New York: Senator Chuck Schumer Introduces Bill on 4/20 to Federally Decriminalize Cannabis.  New York Senator Chuck Schumer, once a leading advocate of federal drug prohibition, has introduced a new bill that would decriminalize cannabis on a federal level, allowing states the freedom to enact their own cannabis laws.  Schumer’s bill would remove cannabis from the list of dangerous drugs scheduled under the Controlled Substances Act of 1970; make funding available to minority- and women-owned canna-businesses; require additional research on the public health impact of nationwide legal cannabis use (including impaired driving); and reserve the federal government’s authority to regulate all commercial cannabis licensing, so that the same restrictions imposed on alcohol and tobacco licenses could be extended to commercial cannabis products.  Read more…

  • Trivia Tidbit: Origins of the term “420” — The association between the number “420” and marijuana began when five high school kids in California met at 4:20 p.m. to look for a mythical, abandoned crop of marijuana plants (using a hand-drawn, treasure map!) in 1971. Source: Snopes.com

Record Number of Running as “Pro-Cannabis Candidates.”  Since several former champions of the War on Drugs, including former Speaker of the House John Boehner (Boehner has been appointed to the board of advisers of Acreage Holdings, a New York City-based canna-business running cultivation, dispensary, and processing operations in 11 states) as well as current Senator Dianne Feinstein, have “done a complete 180” and announced that they now support cannabis reform, it seems that running as the “cannabis candidate” is the popular trend.  From the top five 2020, Presidential candidates to how candidates intend to use the “Marijuana Tax,”  ideas of total prohibition are being traded for legalizing marijuana and reforming various laws in support of safety, regulation, and accountability. We can always hope that such turn-arounds are also influenced by increasing evidence that cannabis is more effective for treating pain than addictive opioids (see below).  See The 2018 Midterms and Marijuana: How Pot Change Will Change the Vote.

Majority of Pain Sufferers Prefer Cannabis to Opioids.  In a new study conducted in cooperation with the University of California Berkeley on pain medications, MMJ community website HelloMD surveyed nearly 3,000 MMJ users regarding cannabis as an effective substitute for opioid and non-opioid medications.  Dr. Perry Solomon, Chief Medical Officer for HelloMD stated, “The latest publication from the National Academy of Sciences clearly refuted the ‘gateway drug’ theory that using marijuana can lead to opioid addiction, instead finding evidence of cannabis having multiple curative benefits… Our study further substantiates this. Hopefully this will awaken the public, medical professionals and legislatures to the fact that cannabis is a safe, non-addictive product, available to help fight the opioid epidemic.”  Amanda Reiman, a lead researchers of the study, said, “Cannabis has been used throughout the world for thousands of years to treat pain and other physical and mental health conditions.”  Read more…

The Importance of Foot Care

Aside from the fact that sandal season is right around the corner, now is a good time to take a look at your foot care practices.  Caring for your feet is paramount because your entire body rests on them! Did you know that your feet have more than 50 bones (which is approximately one-fourth of all the bones in your body), more than 60 joints and 200 muscles, tendons, and ligaments? That’s quite a bit contained in such small packages!  Check out the reflexology chart that shows the areas of the feet that correspond to ALL parts of your body!

Foot health can be an indicator of your overall health. For example, joint stiffness could mean arthritis and swelling might indicate kidney disease, heart disease, or high blood pressure.  Improper foot care can lead to all kinds of pain and discomforts (and “dis-eases”) in your body that can torture you for a lifetime.  Far too many people don’t think about their feet until there is a problem. But a little foot care can go a long way!  Here are some tips for healthy, happy feet. Gentlemen, this is for you, too!

1) Hygiene

  • Pedicures.  Of course, a salon pedicure is ideal (invest in your own set of instruments for sanitary purposes), but you can take care of your feet at home.

Exfoliate.  There are so many, wonderful ways to attend to rough, dry skin!  Use a pumice stone (or make your own by slicing a raw potato in half, then dip it in sea salt) and similar tools to slough away uncomfortable and unsightly skin.  There are mild, chemical treatments to rid your feet of tough callouses (use with caution) and all kinds of gadgets that make quick work of the task.

  • Wash and moisturize your feet daily.  Just because you weren’t walking around barefoot doesn’t mean that your feet are clean. Natural shedding of the skin, sweat residue, sock lint, or shoe debris contribute not only to odor, but to bacteria and fungi. Be certain to wash and dry completely between toes, especially before applying a moisturizer.  Keeping your feet moisturized contributes to better circulation, more mobility in the feet (which yields better balance and spine health), and the prevention of bacteria and fungal growth.

Interesting Note:  Merits of Oiling the Body — “Ayurveda encourages appropriate oiling of the body parts. This needs to be practiced on an everyday basis.  The main reason behind this is that applying and massaging oil onto the body is believed to be a good manner of rendering nourishing and suppleness to both the muscles and the tissues of the body… There are three particular body parts that need to be oiled every single day. These are the scalp, ears, and soles of the feet.”  Read more

  • Keep your toenails trimmed and filed.  Using a toenail clippers, cut toenails right after you bathe and while they are soft.  Cut them straight across, then carefully file to round out the edges. Do not cut your cuticles; use a cuticle remover to gently push overgrown cuticles back into place.

2) Shoes

  • Wear shoes that fit and that are the right size.  Vanity aside, the size of a shoe often varies on manufacturer and design.  Our feet also get bigger and wider with time.  So, don’t be committed to wearing a size 7 if the comfortable fit of the shoe is a size 10.  Wearing improperly-fitting shoes leads to a plethora of conditions including curled “hammer toes,” bunions, painful plantar fasciitis, fungal infections that cause nails to become thick, brittle and discolored, and knee and back pain among other ills.
  • Choose shoes that have proper support, which means that the shoe will bend only at the toes (this, of course, excludes running shoes  and shoes designed for specific functions).
  • Choose shoes for your activity level.  In other words, if you’re going to be walking around all day, stilettos are not a good choice.   Ladies, choose a lower heel (1.5 inches or lower) for walking around and prolonged wear.  Avoid wearing flip-flops around town as they are designed to be worn from the shower to the bedroom and not for the whole day.  (Flip-flop related injuries are a major reason for increased podiatry visits during the summer!)  Impractical foot wear is occasionally OK if you’re not going to spend too much time wearing them or if you’re not going to be very active.

3)  Massage and Exercise.  We know the benefits of massage and exercise for total well-being. But just in case you didn’t know, foot massage benefits can include improved sex life, reduction in depression and anxiety, lowered blood pressure, alleviation of symptoms of PMS and menopause, and so much more! 3,000+ Patients Certified Since Chronic Pain Added To New York Medical Marijuana Program

“The New York State Department of Health announced several milestones in the state’s Medical Marijuana program, including the certification of more than 3,350 patients since the addition of chronic pain as a qualifying condition in late March, the registration of nearly 1,000 practitioners, and the publication of a list of registered practitioners who have consented to be listed publicly…”  Read more…

New York: State’s Medical Marijuana Licensing Panel Found to Have Little Expertise

When New York State approved the use of medical marijuana in 2014, a panel of “experts” said to have deep backgrounds in several fields vetted the applicants to dispense the drug.  NYS has only 5 companies that were chosen by this panel to receive exclusive statewide medical marijuana licenses.  A September 2015 Freedom of Information request by The New York Times, seeking the names of the panel’s members, was delayed nine times, as the department said that it did not “maintain records” or contact information for the panel.  Finally, on May 1, 2017, the department disclosed the names of the panel’s 17 evaluators: “all state employees, most with little or no prior professional experience in medical marijuana.”  Read The New York Times full article.  Items of note:

  • The limited number of companies allowed to dispense MMJ that were chosen by this panel creates difficulties in patient access, including location and expense.
  • A law suit has been brought to prevent the granting of licenses to additional MMJ companies. “’Flooding the supply market when there is insufficient patient demand will undermine the viability of the entire program,’ the lawsuit says, adding that more dispensaries could also make it difficult for companies to raise more capital.”

California: Wine Industry Finds a Companion in a Competitor: Marijuana

With more states legalizing recreational marijuana, the liquor industry is gaining concern for its profit margins, particularly as beer sales have declined.  However, many in the the wine industry believe that marijuana and wine can coexist in harmony and see marijuana as a complement to wine rather than a competitor. It appears that a sense of connoisseurship is what brings together lovers of cannabis, wine, craft beer, and artisanal spirits. Ergo, the first Wine & Weed Symposium (a wine industry initiative) will explore possible business opportunities in California, which legalized recreational marijuana use in November.  Read more…

Preparing For Warmer Weather

Spring cleaning is a wise tradition to clear away the stagnation of months of closed windows and doors. However, it is equally important to cleanse and prep your body for the warmer weather with inner and outer treatments to benefit skin, metabolism, and even improve dealing with the allergy season! Here are a few, easy things that you can do to spring into action!

1) Hydrate. You hear it all of the time, but seriously, not enough can be said on the benefits of proper hydration.  Water can help you stay slim; boost your metabolism and energy; imrpove skin conditions and your overall appearance; and keep you healthy.  More info: 34 Proven Ways Water Makes You Awesome.

2) “Lighten up” your diet.  Limit your intake of saturated fats (fatty meats, bacon, sausage) and eat red meat no more than 2 times a week.  Increase servings of fish and seafood up to three times a week and, of course, eat your veggies!  More info: Spring Clean Your Diet With These 10 Simple Tips

3) Get moving! Yea, yea, we know… Just do it… However, exercise is always easier with a buddy. What a great age to live in where we have just about everything we can want at our fingertips! Meetup.com is a great place to find activity groups with people who share not only your fitness goals and interests, but for just about anything that you can think of, you will find some folks who are into it, too! Search for age groups, locations, specific activities, and more. Have fun!

4) Skin Care. Dealing with winter often dries skin and leaves it less than vibrant and healthy looking.  The basics of preparing your skin for spring are exfoliation (gentle removal of dead skin cells), cleansing (including using a toner), and moisturizing. Cold, Flu, or Allergy?

The discomforts of sniffles, sneezing, and a sore throat can be confusing to know whether you’ve got a cold, flu, or allergies. Because they share so many symptoms, it can be hard to tell them apart. While cold, flu, and allergies all affect your respiratory system, making it hard to breathe, each has its own set of symptoms that set it apart from the others. Understanding the differences can greatly assist you in choosing the best treatment.

Allergies are your body’s immune system reacting to a trigger (“allergen”) that your body is sensitive to – such as dander and pollen. Respiratory tissues may swell and your nose may become stuffed up or runny and may be accompanied by watery, itchy, eyes. Allergies can last approximately 6 weeks during the pollen season (in spring, summer, and fall). These symptoms are not usually experienced with colds and flu.

Caused by viruses, both colds and flu can lead to a sore throat; congestion; a runny, stuffy nose; and coughing. The flu, however, can also cause headache, fatigue, general aches and pain, and a high fever that lasts for 3-4 days. Colds and flu do not usually last longer than 2 weeks and most people recover without medical care. (However, if symptoms last beyond 10 days or aren’t relieved by over-the-counter medicines, check with a health care provider.)

The chart below (from the National Institute of Health) offers an overview of symptoms, treatments, and more.

Being an informed patient puts you in charge of your health and healing.

We encourage you to stay up-to-date with the rapidly changing policies concerning Medical Marijuana (from farming to distribution), especially with the new administration and its choices for its officers.

ATTENTION: WhiteHouse.gov Petition to Keep The Rights of States To Govern Marijuana Laws

“On February 23, Press Secretary Sean Spicer indicated the Department of Justice might begin “greater enforcement” of federal law in states that have legalized marijuana. But during the campaign President Trump repeatedly pledged that if elected, the federal government would respect the rights of states to enact their own cannabis laws. That is a wise policy supported by a growing super-majority of voters. They know that state marijuana legalization laws hurt the cartels, fund our schools and roads, and protect public health and safety. Studies in the Journal of the American Medical Association and others have shown that states with legal and accessible medical and recreational marijuana see a significant reduction in opioid death rates…”
