Hemp vs. Marijuana

Do you know the difference between marijuana and hemp? While both hemp and marijuana are both cannabis, hemp is not marijuana and hemp cannot get you high. Hemp is completely different from marijuana in its function, cultivation and application. If you are able to smoke it and it actually gets you high, then technically it is called marijuana. Otherwise, it is hemp or industrial hemp. Period. In spite of these differences, our political leaders grouped ALL cannabis species as a Schedule I Drug and banned it in 1970 under the Controlled Substances Act. Hemp was made illegal to grow in the US and classified as a drug even though it doesn’t include any of the chemicals that make marijuana a drug. Learn more about the legality of hemp in the United States.

Hemp is a durable crop that grows in a variety of climates and soil types. Hemp’s versatility and strength makes it perfect for a variety of uses including clothing, biofuels, plastics, personal care, construction materials, feed and food. Economic experts predict a multi-billion dollar U.S. hemp industry by 2020. Hmm, maybe that’s why Senate Majority Leader Mitch McConnell (R-KY) (see below) introduced the Hemp Farming Act of 2018 on the Senate Floor… (And maybe why Former Speaker of the House John Boehner has joined the advisory board of a cannabis company, after firmly opposing all cannabis reform while in office?) The proposed legislation would fully legalize hemp, remove it from the Controlled Substances Act, and provide clarity on hemp-derived products in the marketplace.

Throughout the 1700-1800s, cannabis was used as a primary source for our livelihood. That all changed in the early 1900s with wide-spread, propaganda campaigns. Read more: How History Turned On Cannabis and check out a gallery of more, ridiculous, anti-marijuana propaganda ads from the early 20th Century.

Hemp Farming Act of 2018. “Senate Majority Leader Mitch McConnell’s Hemp Farming Act of 2018 aims to establish hemp as an agricultural commodity, protect state regimes, add crop insurance, and bolster research. And right off the bat, the bill quashes questions about whether those hemp-derived CBD-rich extracts are indeed legal…” Read more…

Former Speaker of the House John Boehner has joined the advisory board of a cannabis company, after firmly opposing all cannabis reform while in office. “Boehner has been appointed to the board of advisers of Acreage Holdings, a New York City-based canna-business running cultivation, dispensary, and processing operations in 11 states. Also joining the company’s board of advisors is former Massachusetts Governor Bill Weld, who has more recently served as a board member for a tobacco company. Boehner’s career change is especially shocking considering that the former Congressman said he was “unalterably opposed” to cannabis decriminalization less than a decade ago. In 2011, during his first term as Speaker, Boehner wrote that he was against the “legalization of marijuana” and “concerned that legalization will result in increased abuse of all varieties of drugs,” NORML reports. Even as recently as 2015, Boehner still publicly spoke out against legal weed.” Read more…

Binge Drinking Is On the Decline in States with Legal MJ. a new study found that states with legal access to recreational cannabis have seen a significant decrease in heavy drinking. “Earlier this year, officials at the Center for Disease Control (CDC) released a report detailing a worrying spike in heavy drinking across the country, with 1 in 6 Americans, or 37 million people, consuming more than five drinks within two hours time at least once a week… According to a new report from the financial research firm Cowen & Company, states with comprehensive legal marijuana industries are also home to significantly lower rates of binge drinking, despite an otherwise national trend towards increasingly dangerous alcohol consumption.” Read more…

Important MMJ News!

The past few weeks have been groundbreaking in the fight to legalize cannabis (and protect the rights of MMJ) in the United States. More studies have been published to debunk the myths of “gateway drug,” injection initiation, and encouragement of drug use among teens (see below). And of stellar importance, the first steps in the lawsuit, Washington v. Sessions where 5 plaintiffs (including former NFL player Marvin Washington; 12-year-old Colorado medical refugee Alexis Bortell; youngster Jagger Cotte; US military veteran Jose Belen; and the Cannabis Cultural Association) challenge the constitutionality of the classification of marijuana under the federal Controlled Substances Act got underway right here in New York on February 14.

“The five plaintiffs have sued Sessions and the DEA to declare the classification of cannabis under the Controlled Substances Act unconstitutional on claims it violates their rights, including that to travel, to be engaged in business’ interests, and to be free from racial discrimination and in enforcement of the law against communities of color. The federal government denies those claims and has moved to dismiss the action.” —David C. Holland, a member of the legal team representing plaintiffs in Washington v. Sessions.

So, let’s get this issue started by looking at what’s happening!

Sen. Kirsten Gillibrand of New York Calls Out Big Pharma On Opposing Marijuana.   “To them it’s competition for chronic pain, and that’s outrageous because we don’t have the crisis in people who take marijuana for chronic pain having overdose issues,” Sen. Kirsten Gillibrand said. “It’s not the same thing. It’s not as highly addictive as opioids are.”  Read more…

Medical Cannabis Clearly Saves Lives, Federal Judge Declares. Last week, in a lawsuit that could put an end to federal cannabis prohibition, a federal judge in New York, U.S. District Judge Alvin Hellerstein, acknowledged the healing potential of medical marijuana. “It’s saved a life,” he said, referring to a Colorado girl (Alexis Bortell) with epilepsy. “She has no more epileptic seizures.” The judge then turned to lawyers for the federal government, who have argued that cannabis is a dangerous drug with no accepted medical benefit. “If there is an accepted medical use,” he told them, “your argument doesn’t hold.”  IMPORTANT CASE DETAILS…

red-arrow-icon  Check out the excellent article and interview, Meet the Lawyer Suing Jeff Sessions to End Cannabis Prohibition for more information about Washington vs. Sessions including the history of the Controlled Substance Act, why it takes soooo long to petition the FDA (can take 9 years before being heard for a rescheduling of substance classification and some of the plaintiffs (and others) may not live that long), and the red tape consuming our tax dollars.

UPDATE 2/27/18:

U.S. District Judge Alvin Hellerstein in Manhattan ruled that the lawsuit must be dismissed because the plaintiffs had failed to use administrative procedures within the Drug Enforcement Administration (DEA) to challenge the ban.  Judge Hellerstein was convinced of the medical efficacy of cannabis, but ruled that this lawsuit was not the proper path for changing the legal status of marijuana.  “Resigning the plaintiffs to the petitioning administrative process is tantamount to a death sentence for those patients who need cannabis to live,” said Michael Hiller, an attorney for the plaintiffs.  READ FULL DETAILS

SCIENCE: Cannabis Propaganda Myth Busting

Let’s face it: it’s hard enough to deal with the stigmas and stereotypes of marijuana that most people have to overcome when considering MMJ.  And with non-factual, idiocy actually being presented in schools to children (see Canadian Cop’s Attempt to Educate Kids About Marijuana Ends in Epic Fail – he actually told kids that “doobies lead to boobies” in males!), we present you with some of the most recent, scientific research on the effects of cannabis use.

“As opioid abuse continues to wreak havoc across the U.S. and, to a lesser extent, Canada, American politicians and law enforcement officials have repeatedly brought up the gateway theory as a reason to block cannabis legalization efforts, despite a lack of evidence supporting the “slippery slope” claims. A number of studies, including the new Vancouver research, suggest the direct opposite: marijuana prevalence actually decreases opioid use.” —MerryJane

Cannabis use is associated with lower rates of initiation of injection drug use among street-involved youth: A longitudinal analysis.  This finding challenges the view of cannabis as a gateway substance that precipitates the progression to using harder and more addictive drugs. —US National Library of Medicine National Institutes of Health

Meta-Analysis: Studies Refute Claims That Medical Cannabis Access Encourages Teen Use. The findings are consistent with those of numerous prior studies, including a federally funded 2015 study published in the journal Lancet Psychiatry that assessed marijuana use patterns of over one-million adolescents in 48 states. That paper concluded, [C]oncerns that increased marijuana use is an unintended effect of state marijuana laws seem unfounded.” —NORML.org

Study debunks claim that medical marijuana laws increase recreational pot use for US teens. Legalizing medical marijuana has not increased recreational use of the substance among U.S. adolescents, according to a new study conducted at Columbia University’s Mailman School of Public Health. The findings are published online in the journal Addiction. —Columbia University’s Mailman School of Public Health

Winding Down Winter

Looking forward to springing ahead, take a look at our Preparing For Warmer Weather article with tips on spring cleaning, diet prep, exercise, and skin care.  And because it’s worth repeating,

Cold, Flu, or Allergy?

The discomforts of sniffles, sneezing, and a sore throat can be confusing to know whether you’ve got a cold, flu, or allergies. Because they share so many symptoms, it can be hard to tell them apart. While cold, flu, and allergies all affect your respiratory system, making it hard to breathe, each has its own set of symptoms that set it apart from the others. Understanding the differences can greatly assist you in choosing the best treatment.

Allergies are your body’s immune system reacting to a trigger (“allergen”) that your body is sensitive to – such as dander and pollen. Respiratory tissues may swell and your nose may become stuffed up or runny and may be accompanied by watery, itchy, eyes. Allergies can last approximately 6 weeks during the pollen season (in spring, summer, and fall). These symptoms are not usually experienced with colds and flu.

Caused by viruses, both colds and flu can lead to a sore throat; congestion; a runny, stuffy nose; and coughing. The flu, however, can also cause headache, fatigue, general aches and pain, and a high fever that lasts for 3-4 days. Colds and flu do not usually last longer than 2 weeks and most people recover without medical care. (However, if symptoms last beyond 10 days or aren’t relieved by over-the-counter medicines, check with a health care provider.)

The chart below (from the National Institute of Health) offers an overview of symptoms, treatments, and more.

New Study Shows Marijuana Legalization is Lowering Alcohol Consumption.  While Big Alcohol,  Big Tobacco and Big Pharma are at the forefront of the anti-legalization of marijuana movement, more states are changing their position on cannabis with more than 64 percent of voters nationwide desiring the end of the plant’s prohibition. Marijuana reform has had a significant impact on alcohol sales with a 15-percent decline in some states, according to a new study conducted by researchers from the University of Connecticut and Georgia State University. Researchers sourced data from the Nielsen Retail Scanner database (which records sales data from 90 retail chains nationwide) for more accurate portrayals of actual usage rates.

  • “If people [are] still trying to decide between the two substances need a little help making a choice and weren’t already swayed by sales statistics, the 90,000 lives claimed annually by alcohol abuse may do the trick — especially when you consider that  nobody ever has died as the direct result of cannabis consumption.”  −Constellation CEO Rob Sands. Read MORE of this fascinating article…

Most doctors would prescribe medical marijuana to children with cancer, study shows.  Doc Tommy is interviewed in this article.  A study from Northwestern University surveyed 288 healthcare professionals and found that 92 percent would prescribe marijuana to a child with cancer. But those who were qualified to do so were more reluctant to prescribe a child with the alternative medicine for fear or risking their medical license. This is due to the lack of regulations on dosage for children and some hospitals’ policies that prohibit doctors from prescribing it .  MORE…
